The Insurance Information and Monitoring Center (SBM) is the owner of this website. The users visiting this website shall be hereby deemed to have accepted the following principles and terms, in minimum.

1. General Disclaimer

1.1. According to the Insurance Law and other legislation binding on the Insurance Information and Monitoring Center, e-mail / text / message / mobile application / webpage contents are considered as a confidential document between the related parties even if the contents do not include any confidential information. It cannot be made public, reproduced in any way without informing and obtaining written approval of the Insurance Information and Monitoring Center; its content cannot be partially or completely copied, distributed, leased, altered and it cannot be used or made available for commercial purposes under any circumstances.

1.2. Unauthorized use, reproduction, distribution of information contained in the e-mail / text / message / mobile application / webpage as well as making it available to unrelated parties in any way or using for such actions are prohibited.

1.3. 1.4. For preventing unauthorized accesses to the information received from users during the services provided through the website, we take necessary security measures on the information systems and records related to all activities done through this website are stored according to the confidentiality policy of the Insurance Information and Monitoring Center.

1.5. In case of any breach of this confidentiality rule, actions of the concerned parties shall be considered as a crime under the Insurance Law and Turkish Penal Law. The Insurance Information and Monitoring Center reserves right to claim direct or indirect damages to be suffered by it due to disclosure or use of any document obtained through such means.

2. For Use of Webpage

2.1. The Insurance Information and Monitoring Center (SBM) is the owner of www.sbm.org.tr website and its contents. The users visiting our website shall be hereby deemed to have accepted other terms of use including but not limited to the ones listed below.

2.2. According to Article 31/B of the Insurance Law, all formalities and records of the Insurance Information and Monitoring Center are confidential. Parties related to the Insurance Information and Monitoring Center or receiving information published by the Insurance Information and Monitoring Center in any way cannot disclose such information to any other or make such information available to any party, excluding authorized parties, or such information cannot be used for any commercial or social activity even if such activity is non-profit. This prohibition on disclosure applies even if the acquired information is made public by the Insurance Information and Monitoring Center and it is not considered a secret. Parties breaching this obligation shall be punished with one year to three years jail sentence and punitive fine not less than two hundred days. The concerned legal entities shall be subject to the security measures listed on the Turkish Penal Law.

2.3. The Insurance Information and Monitoring Center’s website and its contents are not commitments made to any person or organization about any topic.

2.4. The users might refer to the information and documents available on the website only for information purposes. Even if the available information is made public by the Insurance Information and Monitoring Center, the information cannot be partially or completely copied, distributed, leased, reproduced, made available through sublicenses, altered, kept to be used in the future and used for any commercial and promotion activity even such activity is a non-profit event without prior written consent of the Insurance Information and Monitoring Center.

2.5. The Insurance Information and Monitoring Center and its partners hold all rights that can be considered under the scope of copyrights, registered trademark, patent and proprietary rights such as information, design, image and logo used on www.sbm.org.tr, excluding the ones owned by the third parties. Such rights cannot be used without written permit of the Insurance Information and Monitoring Center and cannot be used for commercial purposes.

2.6. The Insurance Information and Monitoring Center reserves the right of changing all information and design on www.sbm.org.tr website and affiliated electronic platforms without any notice.

2.7. The Insurance Information and Monitoring Center does not assume any responsibility related to damages or losses suffered or to be suffered because of information published on the website or transactions based on such information or failure to have access to the website. Responsibility for all sorts of decision and action based on information available on the website shall be on account of the person receiving and using such information. The Insurance Information and Monitoring Center shall not be responsible. The information available on the website cannot be used as evidence in case of any legal dispute.

2.8. The Insurance Information and Monitoring Center cannot be held responsible for direct or indirect losses or damages arising from accessing to or use of www.sbm.org.tr website or any website redirected from this website. Responsibility of the redirected website belongs to the owner of that website.

3. For SMS 5664 Query Messages

3.1. Content of the message is consisted of records forwarded to the Insurance Information and Monitoring Center by the Insurance Companies. It does not include any information not recorded by the Insurance Companies or not forwarded to the Insurance Information and Monitoring Center.

3.2. This message is confidential between the person making a query and the Insurance Information and Monitoring Center.

3.3. It cannot be used as evidence in case of any dispute or for any commercial purpose and it cannot be reproduced. Otherwise, any action shall be considered as a crime under the Insurance Law and Turkish Penal Law.

3.4. Information used on a message to reply SMS Queries is entered into our center’s records by the Insurance Companies and thus the Insurance Information and Monitoring Center (SBM) does not assume any legal liability related to the contents of message sent as a reply. The Insurance Information and Monitoring Center cannot be the subject of any objection related to possible information errors contained on the message.

3.5. If it is determined that the information used on the message to reply to SMS queries is wrong or incomplete, you should refer to the concerned insurance company.

3.6. Damage information provided with Damage History Query service is limited to the motor own damage insurance and traffic insure claim payments made by the insurance companies as of 2003. The damage information does not include glass damage payments.

3.7. For report query service, Accident Report (KTT) issued by the parties involved in the traffic accident and Mobile Accident Report (MKT) information is taken as basis. Accident reports issued by the police and gendarmerie are not covered by this service.

4. For Sigortam360 Website Queries

4.1. Information provided as the result of a query is consisted of records forwarded to the Insurance Information and Monitoring Center by the Insurance Companies. It does not include any information not recorded by the Insurance Companies or not forwarded to the Insurance Information and Monitoring Center.

4.2. This query is confidential between the person making a query and the Insurance Information and Monitoring Center.

4.3. It cannot be used as evidence in case of any dispute or for any commercial purpose and it cannot be reproduced. Otherwise, any action shall be considered as a crime under the Insurance Law and Turkish Penal Law.

4.4. Information provided for Sigortam360 Queries is entered into our center’s records by the Insurance Companies and thus the Insurance Information and Monitoring Center (SBM) does not assume any legal liability related to the information provided as a result of the query. The Insurance Information and Monitoring Center cannot be the subject of any objection related to possible errors about the information provided.

4.5. If it is determined that the information provided for Sigortam360 queries is wrong or incomplete, you should refer to the concerned insurance company.

5. For Use of Mobile Applications

5.1. Mobile Accident Report (MKT) is filled out and sent to the Insurance Information and Monitoring Center’s records.

5.2. The applicant is responsible for the information provided. Any misstatement is considered a crime under the Insurance Law numbered 5684 and Turkish Penal Law.

5.3. The Insurance Information and Monitoring Center and Insurance Company do not assume any responsibility about the contents of the filed report.

5.4. The information shall be kept with the Insurance Information and Monitoring Center’s records; it shall be shared with the Insurance Companies and used for the third party queries in the future.

5.5. Once the MKT formality is approved, the filed information is forwarded to the concerned Insurance Company and a record of damage is generated to be used for queries.

5.6. In addition to the MKT, the concerned party must notify the insurance company about the damage.

5.7. For your safety, you should protect your personal data on all platforms, including the mobile application.

5.8. Do not keep your full ID number, vehicle registration place and such other information in writing at the same place and exposed.

5.9. Do not use the same password for different internet applications.

5.10. You must definitely use applications such as security password and key lock for preventing access to your mobile phone and computer by third parties other than you.

5.11. Download all applications from secure mobile application stores for being protected from malware.

5.12. Do not open e-mails and attachments you receive on your mobile phone and computer from unknown senders.

5.13. Use updated antivirus software prepared for mobile phones and computers.

5.14. Do not share your personal information with persons who present them as personnel of the Insurance Information and Monitoring Center. If you have any suspicions, please complete the contact form available on www.sbm.org.tr and send it to the Insurance Information and Monitoring Center.

5.15. Do not use wireless networks such as public and unsecured Wi-Fi and Bluetooth if you are not sure about its safety. Do not accept any files sent over Bluetooth if you do not know the source and level of security.

5.16. Turn off your applications such as Wi-Fi and Bluetooth when you do not need them.
